FitViz Pro Software License Agreement

1. Grant of License

Subject to the terms of this Agreement, the Company grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Software for your personal or business fitness management purposes. This license does not grant you ownership of the Software or any intellectual property rights therein.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. You must provide accurate, current, and complete information during registration and keep your account information updated.

3. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the Software
• Copy, modify, or distribute the Software without authorization
• Use the Software for any unlawful purpose or in violation of applicable laws
• Attempt to gain unauthorized access to other accounts or systems
• Transmit malicious code, viruses, or harmful data through the Software
• Use automated tools to scrape, collect, or harvest data from the Software
• Sublicense, lease, rent, or otherwise transfer your access rights

4. Data and Privacy

Your use of the Software is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Software, you consent to the collection and use of your data as described in our Privacy Policy. We implement industry-standard security measures to protect your data, but cannot guarantee absolute security.

5. Intellectual Property

All content, features, functionality, trademarks, and intellectual property associated with the Software are owned by the Company or its licensors. You retain ownership of any data you submit through the Software, but grant us a license to use such data as necessary to provide our services.

6. Subscription and Payment

Certain features of the Software require a paid subscription. Subscription fees are billed in advance on a recurring basis according to the plan you select. You authorize us to charge your designated payment method for all applicable fees. Failure to pay may result in suspension or termination of your account.

7. Termination

We may suspend or terminate your access to the Software at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Software ceases immediately. Provisions that by their nature should survive termination shall remain in effect.

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SOFTWARE.

10. Indemnification

You agree to indemnify and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Software or violation of this Agreement.

11. Modifications

We reserve the right to modify this Agreement at any time. We will notify you of material changes via email or through the Software. Your continued use of the Software after such modifications constitutes acceptance of the updated terms.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is incorporated, without regard to its conflict of law provisions.
